Step 1: Write a Patent specification

Creating a patent document is the initial stage of applying for a patent. In this document, you outline the details of your invention in a clear and brief manner. Whether it’s a draft or the final version, it should start with a title and finish with your signature and the date, or that of your patent representative.

Format:

The format and content of any official document, particularly those that deal with legality, are crucial. You must use carefully chosen language, explain the titles and definitions, and list the details in an orderly manner. Despite their simplicity, the following instructions are very crucial to your application:

  • Use English as the language.
  • Set the line spacing to 1.5.
  • Choose A4 as the page size.
  • Keep margins of at least 2 cm on the top, bottom, and right.
  • Print or write on one side of the paper only.

Structure or Content:

When writing your patent details, make sure to have:

Title: The name of your invention.
Summary: A brief overview explaining its main technical features (about 2 pages).
Field: Which area or technology does your invention belong to?
Background: Why did you create it? What inspired you?
Description: Provide a clear and thorough explanation of how your invention works. Make it understandable so experts can follow and reproduce it.
Claims: Clear statements that precisely define what your invention is.
Illustrations: Add drawings if they help explain your invention better.

Provisional Patent Specification:

To secure a date for your ongoing invention, start by submitting a basic outline called a provisional specification. Within a year, follow up with a detailed description. Since the initial outline isn’t reviewed by the Patent Office, you can leave out specific details like claims and drawings, and include them when you submit the full description later.

Step 2: Filling the form

To apply for a patent, you need to complete certain forms:

  • Choose either ‘Form P-1’ (for unique applications) or ‘Form P-2’ (for standard applications) to start your patent process. You’ll need to send two copies of this form and two copies of the Patent Details.
  • If someone other than the original inventor is applying, use ‘Form P-1A’ for unique cases or ‘Form P-2A’ for standard ones. Again, submit two copies of each.
  • Use ‘Form P-3A’ for full details and ‘Form P-3’ for preliminary details. Send two copies of both.
  • If you’re from a university or research group, include a support letter with your application.
  • Also, include two copies of ‘Form P-28’ if you’re authorizing a patent agent or attorney with your Form P1 or P2.
  • If you need to change any details in a current or accepted patent, use ‘Form P-16

Step 3: Pay the filing fees

To apply for a patent in Pakistan, the fees are as follows:

  • For a complete patent description: Starting at PKR. 6750/-
  • For a temporary or provisional patent description: Starting at PKR. 2025/-
  • Each additional page beyond 40 pages: Starting at PKR. 90/- per page
  • Each additional claim beyond 20 claims: Starting at PKR. 225/- per claim
  • Amendment of a pending or accepted patent description: Starting at PKR. 2250/-
  • Request for sealing the patent: Starting at PKR. 6750/-

Patent Renewal and Restoration

After getting a patent approved, the owner needs to renew it every year from the 5th to the 20th year. If they don’t, the Patent Office can cancel it.

To keep a patent active, the owner has to fill out a renewal form (Form P-12) by the end of the 4th year. The renewal fees go up over time.

If the renewal fee isn’t paid on time, the Patent Office will temporarily hold the patent. If the fee isn’t paid later on, they might cancel it. But, the patent owner can ask for it back by filling out another form (Form P-13) before it’s fully canceled.

Once a patent is 20 years old, its details become public. This means anyone can use the information to make improvements. But, you can’t get a new patent for something that’s already been disclosed for that long.
